Its possible that I'm being the big stupid right now but my coc2 hasn't updated, do I have to re-download it to get the latest patch?

If you are using the non-steam download versions you have to redownload to get the latest patch, yes.
If I download the steam version can I still transfer the save files from my computer to phone (and vice versa)?
Save files are compatible across all the different distributions of the game. All the different distributions have the save to file/load from file feature.
