I have a question. What falls under, for lack of a better term, creative commons. I don't mean the definition, I'm asking about the stuff that people have made for TiTS. Of all the content so far, is there any that a person could build upon without stepping on any toes?

I believe that most everything written for TiTs belongs to Fen, even when others write it they give up their rights to him if they submit it. So you'd just need permission from Fen to work on someone else's work if author isn't available. But as for just writing on material based off of someone else's stuff, you could do it, but you might piss off the original author.

Only stuff explicitly given to the game is owned by the game. You own everything else about the concept/character.

The way I understand it, it is your creation until it is slapped into the game, then it belongs to those who actually make the game (IE Fen) as well as you. I mean, you don't get Patreon pennies, but you do get credit and its a reputational thing at that point.

I can take Ceria and write another story that she appears in.  If I wanted to make reference to any aspect of the TiTS setting, the rights get murkier.  If I wrote a sidestory and published it free to view, sure, I don't think Fen's going to go giving anyone any trouble over it.  If I wrote a sidestory and monetized it, he's probably within his rights to contest it.

The practical solution is don't use things from TiTS in other things.  Don't take your character and use them in another story, make another character who's suited for that story.  If you want to take your waifu and use her in a oneshot D&D game, sure, but if you're writing a new Super Waifu Simulator game, don't take a TiTS character you own and shove them in there.  This isn't about licenses, it's just about not being lazy.
